By accessing or using our website, you agree to be bound by these Terms and all policies referenced herein, including our Privacy Policy. If you do not agree, you may not use the Service.
Overview
This website is operated by FiredUp Firefighter Promotional Exam Prep, LLC ("FiredUp," "we," "us," or "our"), based in Reno, Nevada. FiredUp offers an online platform for professional firefighters to create custom quizzes for promotional exam preparation, using questions we develop from various sources. By visiting our site or purchasing from us, you engage in our "Service" and agree to these Terms, which apply to all users, including browsers, vendors, customers, and contributors. Any new features or tools added to the Service are also subject to these Terms.
Acceptance of Terms and Eligibility
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province and have the legal capacity to enter this agreement, or that you have consent to allow minor dependents to use the Service under your supervision. The Service is intended for currently employed professional firefighters, primarily in the United States, with potential future international expansion. Users outside the U.S. must comply with local laws. You may not use the Service for illegal or unauthorized purposes, including violating copyright laws.
User Accounts and Security
To access the Service, you must register with accurate, current, and complete information, updating it as needed. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us at legal@firefighterpromotion.com of any unauthorized use. Your content (excluding payment information) may be transferred unencrypted over networks to adapt to technical requirements.
Account sharing is strictly prohibited; each account is intended for use by a single individual only, specifically the original purchaser or, for agency accounts and bulk subscriptions, the named member assigned the seat. Sharing login credentials with others, including but not limited to family members, colleagues, departments, unions, or any third parties, is a material breach of these Terms. This prohibition applies equally to all subscription types, including monthly, annual, lifetime, and bulk subscriptions. We monitor account activity, including but not limited to IP addresses, device information, login patterns, and session data, to detect potential sharing or unauthorized access.
If we suspect account sharing or unauthorized use, we may take immediate action, including but not limited to: (i) limiting your account to a single active session at a time; (ii) enforcing two-factor authentication (2FA) via email or other methods; (iii) suspending or terminating your account without notice or refund; and/or (iv) pursuing legal remedies, including seeking damages, injunctive relief, and reimbursement of attorney's fees and costs. Violations may result in permanent bans, and we reserve the right to report such activities to relevant authorities if they involve fraud, intellectual property infringement, or other illegal conduct.
Service Description and License
FiredUp provides subscription-based tools for creating quizzes from our proprietary question bank to aid firefighter promotional exam preparation. We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use by a single individual, subject to these Terms. We strive for accessibility but do not guarantee uninterrupted service. Pricing and features may change without notice.
Book Ownership Requirement
To access and use questions related to specific books on our service, you must comply with the following:
You must own a legitimate copy of the book, purchased from an authorized retailer or publisher.
If you do not own the book, you must purchase it before accessing related questions. We provide links to authorized publishers for your convenience.
Accessing questions without owning the book is strictly prohibited and may result in account suspension or termination.
This requirement is in place to respect copyright laws and support the publishers of the educational materials.
By using our service, you agree to comply with this Book Ownership Requirement.
If we determine that you do not own the required book, we will ban you from our service without a refund.
Intellectual Property and User Submissions
All content on the Service, including but not limited to questions, quizzes, text, software, and other materials (collectively, "Content"), is the exclusive property of FiredUp or its licensors and is protected by United States copyright laws and international treaties. You are granted a limited, non-exclusive, non-transferable license to access and use the Content solely for your personal, non-commercial use in connection with the Service, subject to these Terms.
You are expressly prohibited from:
Copying, reproducing, distributing, transferring, or sharing any Content outside of the Service.
Removing, extracting, exporting, or otherwise attempting to obtain Content from the Service for use outside the platform.
Using any automated means, such as scraping or data mining, to access or collect Content.
Facilitating or enabling account sharing that results in unauthorized access to or distribution of Content.
Any unauthorized use, reproduction, distribution, or disclosure of the Content is strictly prohibited and may constitute copyright infringement. This includes any attempt to remove or extract questions from the Service to share or post publicly, such as on external websites, forums, or other platforms. FiredUp reserves the right to enforce its intellectual property rights to the fullest extent of the law and to seek all available legal remedies, including but not limited to damages (actual, statutory, or liquidated), injunctive relief, and attorney’s fees, in the event of any infringement or unauthorized use of its proprietary Content, including violations arising from account sharing.
All questions and content provided by our service are original and created by our team. We do not copy, reproduce, or distribute any copyrighted material from third parties without proper authorization. Our content is developed based on our own knowledge, research, and expertise, ensuring that it is unique and does not infringe on any existing copyrights. By using our service, you acknowledge and agree that all content is our original work and that you may not reproduce, sell, or exploit our Content without our prior written permission.
By creating quizzes or submitting feedback, ideas, or other content ("Submissions") through the Service, you represent and warrant that your Submissions do not infringe upon the intellectual property rights of any third party. You grant FiredUp a perpetual, worldwide, royalty-free, irrevocable license to use, modify, reproduce, distribute, and display such Submissions for our business purposes, as permitted by applicable law. We are not obligated to keep Submissions confidential, compensate you for them, or respond to them.
Subscriptions and Payments
FiredUp offers monthly and annual subscriptions, billed automatically via Stripe until canceled. Annual subscriptions are billed once per year. When upgrading from a monthly to an annual subscription, the unused portion of the current monthly period is credited toward the annual price. Cancel via your account or by emailing legal@firefighterpromotion.com, with access continuing until the billing period ends. We reserve the right to refuse or limit orders. Legacy "Lifetime Access" plans are honored for the lifetime of FiredUp’s operation, terminating if we close, with no refunds. Lifetime users have fewer retention rights than active subscribers. You must provide accurate billing information and update it as needed. Payments are processed by Stripe; we store only the last 4 digits of your card and data required by Laravel Spark 5.0.
Agency Accounts: End User License Agreement
This section is the End User License Agreement ("Agency EULA") for fire departments, agencies, districts, unions, academies, and other organizations ("Agency") that buy access to the Service for their members, including through an agency account, seats, or a bulk subscription. The Agency EULA is part of these Terms. Where the Agency EULA and the rest of these Terms conflict, the Agency EULA controls for the Agency and its members.
1. When This Agency EULA Applies
If an Agency needs a signed contract, purchase agreement, or procurement terms, ask us at legal@firefighterpromotion.com. A written agreement signed by an authorized officer of FiredUp controls over this Agency EULA to the extent the two conflict. In every other case, this Agency EULA is the entire agreement for the agency account. Pre-printed or standard terms on a purchase order, vendor registration form, invoice-processing portal, or similar document do not apply to FiredUp and do not change this Agency EULA, even if FiredUp accepts, signs, or processes that document.
An Agency accepts this Agency EULA, and the person acting for the Agency represents that they have authority to bind it, when any of the following happens: an agency account is requested or set up for the Agency; the Agency pays an invoice or fee; an administrator signs in to the agency account; or the Agency invites, adds, or approves members, or allows members to join through its email domain.
2. License
Subject to payment and to these Terms, FiredUp grants the Agency a limited, non-exclusive, non-transferable, non-sublicensable, revocable license, for the subscription term, to let its members use the Service for the Agency's internal training and promotional exam preparation. Each seat is for one named individual at a time. Seats may not be shared, pooled, or used by anyone other than the named member. The Agency may reassign a seat from a departing member to a new member, but not to rotate one seat among several people. The Agency may not resell, rent, or sublicense access, use the Service to build a competing product, or use Content to train, test, or prompt any artificial intelligence or machine learning system.
Every member remains bound by the rest of these Terms, including the Book Ownership Requirement and the account-sharing rules. FiredUp and its licensors keep all rights, title, and interest in the Service and the Content. No rights are granted except those expressly stated here.
3. Administrators and Members
The Agency appoints one or more administrators. Anything an administrator does in the agency account is treated as done by the Agency. The Agency is responsible for:
Making sure only its own current personnel, and email domains it controls, are added or allowed to join.
Having the authority, and giving any notices or getting any consents, needed to provide member information to FiredUp and to let FiredUp use it as described in these Terms and our Privacy Policy.
Removing members promptly when they leave the Agency or should no longer have access.
Its members' compliance with these Terms, and every act or omission of its administrators and members.
When a member joins an agency account, the Agency manages that account. Administrators can see the member's study activity, usage, and results, reset or change the member's password, and deactivate the account. FiredUp may act on an administrator's instructions about a member account without checking with the member, and is not responsible for any administrator's decisions about members. A member removed by the Agency may be offered the option to keep studying on a personal subscription.
4. Fees, Invoices, and Renewal
Fees, seat counts, and the subscription term are as stated in FiredUp's quote, invoice, or order confirmation. Unless stated otherwise there, fees are billed annually in advance, are due within thirty (30) days of the invoice date, and are payable in U.S. dollars. All fees are non-cancellable and non-refundable, including for unused seats, members who never sign in, and early termination by the Agency, except where these Terms expressly provide a refund. Seats added during a term are billed for the rest of that term. Seat counts may not be reduced during a term.
Overdue amounts accrue interest at 1.5% per month, or the highest rate allowed by law if lower. FiredUp may suspend the agency account and all member access while any amount is more than fifteen (15) days overdue, and the Agency will pay reasonable costs of collection. Fees exclude taxes. The Agency pays all applicable taxes, other than taxes on FiredUp's income, unless it gives FiredUp a valid tax-exemption certificate.
Each subscription term renews automatically for another term of the same length unless either party gives written notice of non-renewal at least thirty (30) days before the term ends. FiredUp may change fees for a renewal term by giving notice at least forty-five (45) days before the renewal.
5. Data
"Agency Data" means the information the Agency or its administrators give FiredUp about the Agency and its members, such as names, email addresses, ranks, roles, groups, and email domains. The Agency grants FiredUp a worldwide, royalty-free license to use Agency Data to provide, support, secure, and improve the Service, and for the other purposes described in these Terms and our Privacy Policy.
FiredUp owns all usage data, statistics, and other information generated by the operation of the Service, and all aggregated or de-identified data derived from Agency Data or member activity (together, "Service Data"). FiredUp may use Service Data for any lawful purpose during and after the term, including analytics, benchmarking, product development, research, and marketing, as long as FiredUp does not publicly identify an individual member without that member's permission.
When an agency account ends, members lose agency-paid access. FiredUp keeps member accounts, study history, and Service Data according to its normal retention practices, and has no obligation to export or return data except as required by law.
6. Publicity and Marketing
The Agency grants FiredUp a non-exclusive, worldwide, royalty-free license, during the term and for a reasonable wind-down period afterward, to use the Agency's name, logo, patch, and other marks to identify the Agency as a FiredUp customer. This includes use on FiredUp's website, customer lists, sales materials, proposals, social media, email, advertising, and presentations. FiredUp may also publish case studies, success stories, and statistics about the Agency's use of the Service based on aggregated or de-identified Service Data. FiredUp will follow reasonable brand-usage guidelines the Agency provides in writing.
FiredUp may use the contact details of the Agency's administrators, and of its members, to send information about the Service, including product updates, new content, exam-prep offers, renewal and upgrade offers, and invitations to events, surveys, and testimonials. Every marketing email includes a way to unsubscribe. Unsubscribing from marketing does not stop service, security, billing, or account messages.
The Agency may withdraw the publicity permission in this section by emailing legal@firefighterpromotion.com. FiredUp will stop new uses within thirty (30) days of receiving the notice, but does not have to recall or change materials already printed, published, or distributed. Quotes and testimonials attributed to a named person are used only with that person's permission.
7. Feedback and Confidentiality
FiredUp may use, without restriction or payment, any feedback, suggestions, source requests, or ideas that the Agency or its members provide. FiredUp's pricing, quotes, non-public product information, and the Content are FiredUp's confidential information and trade secrets. The Agency will not disclose them except to its personnel who need to know them, or as required by law. If the Agency receives a public-records or similar request covering FiredUp's confidential information, it will, where the law allows, notify FiredUp promptly and before disclosure so that FiredUp can seek an exemption or protective order.
8. Suspension and Termination
FiredUp may suspend or limit the agency account, or any member account, immediately if FiredUp reasonably believes there is account sharing, unauthorized access, non-payment, a security risk, or a breach of these Terms. FiredUp may terminate the agency account (a) for the Agency's breach, with no refund; or (b) for any other reason on thirty (30) days' notice, in which case FiredUp will refund prepaid fees for the unused part of the term. That refund is the Agency's only remedy for termination under (b). The Agency may end the agency account at the end of any term by giving non-renewal notice as described above. Sections 5 through 10 of this Agency EULA, and any unpaid fees, survive termination.
9. Warranties, Liability, and Indemnity
The Service is provided to the Agency "as is" and "as available," as described in the Disclaimers section of these Terms. FiredUp does not warrant any exam result, promotion outcome, or that practice material matches any particular exam. To the maximum extent permitted by law, FiredUp's total liability arising out of or relating to the agency account, in contract, tort, or otherwise, will not exceed the fees the Agency actually paid to FiredUp in the twelve (12) months before the event giving rise to the claim. FiredUp is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, or the cost of substitute services.
To the extent permitted by the law that applies to the Agency, the Agency will defend, indemnify, and hold harmless FiredUp and its officers, employees, and agents from all claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of Agency Data, the acts or omissions of its administrators and members, or the Agency's breach of these Terms.
10. General
The Governing Law section of these Terms applies to this Agency EULA, except where a law that cannot be waived requires a public Agency to use the law or courts of its own jurisdiction. The Agency may not assign this Agency EULA without FiredUp's written consent. FiredUp may assign it in connection with a merger, acquisition, or sale of assets. FiredUp may update this Agency EULA as described in Changes to Terms. For an agency account, changes that materially reduce the Agency's rights take effect at the next renewal, unless they are required by law or needed for security. FiredUp may give notices to the Agency by email to any administrator. The Agency sends notices to legal@firefighterpromotion.com.
Refund Policy
Refunds are handled on a case-by-case basis. If you request a refund and have not used the Service excessively during the billed period, we may issue one. Excessive use includes, for example, answering or viewing a substantial number of questions—such as 200 questions in a single billing cycle. We retain the right to refuse refunds if your usage is deemed excessive or otherwise abusive, or if account sharing or other violations have occurred, or for other reasons.
Agency accounts are governed by the fee and refund terms in the Agency EULA. Annual subscriptions represent a commitment for the full subscription period. Refund requests for annual plans will only be considered within the first 30 days of the subscription start date, and only if the Service has not been used excessively during that period. After 30 days, annual subscriptions are non-refundable. Cancellation of an annual plan will result in continued access until the end of the paid period, with no partial refund for the remaining term.
Data Retention and Deletion
We aim to retain your quizzes as long as possible. Active subscribers' content is preserved during their subscription where feasible. For non-subscribers or lifetime access users, we may delete quizzes to optimize database efficiency, with no liability for loss of content.
Information on the Service is for general use and may not be accurate, complete, or current. It should not be your sole basis for decisions without consulting more reliable sources. Historical information is for reference only. We may correct errors or omissions without notice and have no obligation to update content unless required by law.
Third-Party Tools and Links
We may provide third-party tools or links "as is" without warranties or control. Your use of such tools or sites is at your own risk, and we are not liable for any resulting damage. Review third-party terms and policies.
Prohibited Uses
You may not use the Service for unlawful purposes or to:
Infringe intellectual property rights
Upload viruses or malicious code
Solicit or perform unlawful acts
Harass, defame, or discriminate
Spam, phish, or scrape
Share accounts or facilitate unauthorized access by others
Violations may result in immediate termination of your access.
Disclaimers and Affiliation
The Service is provided "as is" without guarantees of uninterrupted access, accuracy, or exam success. We do not warrant that practice material matches real exams. FiredUp is not affiliated with Fire Protection Publications or the International Fire Service Training Association. Use is at your sole risk.
Limitations of Liability
FiredUp, its affiliates, and agents are not liable for any direct, indirect, incidental, or consequential damages, including lost profits or data, arising from your use of the Service, to the maximum extent permitted by law. Liability is limited where exclusions are not allowed.
Indemnification
You agree to indemnify and hold harmless FiredUp, its officers, employees, and agents from claims, damages, or expenses, including legal fees, due to your breach of these Terms or violation of third-party rights, including but not limited to breaches related to account sharing or unauthorized access.
Termination
We may terminate your access at our discretion, without notice, for any reason, including breaches. You may terminate by ceasing use or notifying us. Obligations prior to termination survive.
Entire Agreement and Severability
These Terms, with referenced policies, constitute the entire agreement between you and FiredUp, superseding prior agreements. If any provision is unenforceable, it will be severed, and remaining provisions remain valid.
Governing Law
These Terms are governed by the laws of Nevada and the United States. Disputes are subject to the exclusive jurisdiction of Reno, Nevada courts.
Changes to Terms
We may update these Terms by posting revisions here. Continued use after changes constitutes acceptance. Check this page periodically.
